When purchasing a property within a homeowners association (HOA), it’s important to request a resale certificate as part of the due diligence process. This document, typically provided by the HOA or its management company, outlines key details about the property and the association, including current dues, outstanding fees, special assessments, and any violations tied to the unit. It may also include governing documents, financial statements, and insurance information. Buyers should request the resale certificate early in the transaction to allow enough time for review, as it can reveal financial or legal issues that may affect the purchase decision or require resolution before closing. It is important to note that in most cases failure to request a resale certificate does NOT negate the owner’s responsibility for past-due balances. In fact, doing so may cause the new owner to automatically assume the debt of the previous owner. Whether you are closing with a title company or an attorney (including online legal assistance), it is the buyer’s responsibility to request the resale certificate.
